What
is a Designated
Agent and Dual Agency?
In Louisiana, the agent you are
working with is DESIGNATED to you. This agent
works for YOU and represents YOUR interests regardless
who pays the commission. If you are selling a
house, the agent you are working with represents you,
the seller. If you are buying a house, the agent
you are working with represents you, the buyer.
If the buyer's agent is also
the seller's agent, this creates DUAL AGENCY in which
the one agent represents the buyer AND seller in
contract negotiations. Imagine if an
attorney represented both the plaintiff and defendant
... How can each side be fairly represented?
Because this can be a difficult situation for a real
estate agent knowing motivation for buying or
selling, bottom selling price, client financial status
and other confidential information DUAL AGENCY is only
allowed if BOTH clients provide written consent to
this agency arrangement.
